The terms.

Marketifyall is an all-in-one AI marketing platform. It brings together tools for content creation, social media management, email and SMS campaigns, websites and funnels, customer relationship management (CRM), SEO and AI-search visibility, analytics, and related marketing workflows — many of them powered by artificial intelligence.

We are continually improving the Service. We may add, change, suspend, or remove features at any time, and we may set limits on certain features or restrict access to parts of the Service, with or without notice. We are not liable to you or any third party for doing so.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement.

To use most features you must create an account. You agree to provide accurate, current, and complete information and to keep it up to date.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at hello@marketifyall.com if you suspect any unauthorized use. We are not liable for any loss arising from unauthorized use of your account.

The Service offers free and paid plans. Paid plans are billed in advance on a recurring basis (for example, monthly or annually) through our third-party payment processor. By subscribing, you authorize us and our processor to charge your payment method for the applicable fees, including any taxes.

Some features are metered using credits or usage allowances. Unless we state otherwise, credits may expire at the end of a billing period, do not roll over, and have no cash value.

Subscriptions renew automatically until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you retain access until then.

Except where required by law, fees are non-refundable, and we do not provide refunds or credits for partial billing periods, unused credits, or features you did not use. We may change our prices; we will give reasonable advance notice, and changes apply to your next billing cycle.

You agree to use the Service lawfully and responsibly. You will not, and will not allow others to:

• Violate any applicable law or regulation, including anti-spam, telemarketing, data-protection, intellectual-property, and consumer-protection laws;
• Send unsolicited, deceptive, or unlawful messages, or contact people who have not consented or who have opted out;
• Upload or distribute malware, or attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Reverse engineer, decompile, scrape, or copy the Service except to the limited extent permitted by law;
• Resell, sublicense, or commercially exploit the Service except as expressly permitted (for example, under an approved white-label arrangement);
• Create or distribute content that is illegal, infringing, defamatory, harassing, hateful, deceptive, or sexually exploitative, or that impersonates others;
• Use the Service to generate spam, disinformation, or content that violates the policies of connected third-party platforms; or
• Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure.

We may investigate suspected violations and take appropriate action, including removing content and suspending or terminating accounts.

"Your Content" means the text, images, audio, contacts, brand assets, and other materials you upload to, create with, or generate using the Service. As between you and us, you retain ownership of Your Content.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for example, to format or resize), and transmit Your Content solely as needed to operate, provide, secure, and improve the Service — including sending it to the third-party services and AI providers described below.

You are solely responsible for Your Content and for ensuring you have all rights, consents, and permissions necessary to use it — including the consent of any individuals you contact or whose personal information you upload. You represent that Your Content and your use of the Service do not violate these Terms or any law or third-party right.

The Service uses artificial intelligence to help you generate content such as text, images, and other outputs ("AI Output"). AI Output is produced automatically and may be inaccurate, incomplete, outdated, biased, or otherwise inappropriate.

We make no guarantee that AI Output is accurate, original, or fit for any purpose. You are responsible for reviewing, editing, and verifying any AI Output before you rely on it, publish it, or send it to others. Do not treat AI Output as legal, financial, medical, or other professional advice.

As between you and us, and subject to these Terms and the rights of our AI providers, you retain rights to the inputs you provide and the AI Output you generate, and you may use them for your lawful purposes. Because AI systems may produce similar outputs for different users, we cannot guarantee that AI Output is unique to you.

The Service integrates with third-party products and platforms — for example, social networks, email and SMS delivery providers, payment processors, analytics tools, and AI providers. When you connect a third-party account (for example, via OAuth) or use an integration, you authorize us to access and exchange information with that service on your behalf.

Your use of any third-party service is governed by that provider's own terms and privacy policies. We do not control third-party services and are not responsible for their availability, content, or practices. A third party may change or discontinue its integration at any time, which may affect related features of the Service.

The Service — including its software, design, text, graphics, logos, and trademarks, but excluding Your Content and AI Output — is owned by QuickShift Labs or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes in accordance with these Terms.

You may not use our name, logos, or branding without our prior written permission, except as allowed under an approved white-label or reseller arrangement. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them to improve the Service.

We care about your privacy. Our Privacy Policy explains what information we collect, how we use and share it, and the choices and rights you have. By using the Service, you also agree to our Privacy Policy.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content or AI Output will be accurate or reliable. You use the Service at your own risk.

To the fullest extent permitted by law, QuickShift Labs and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service.

Our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or USD 100. Some jurisdictions do not allow certain limitations, so parts of the above may not apply to you.

You agree to defend, indemnify, and hold harmless QuickShift Labs and its officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if we are required to by law, or to protect the Service, other users, or third parties.

Upon termination, your right to use the Service ends. We may delete Your Content after a reasonable period in accordance with our Privacy Policy and data-retention practices. Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, and indemnification — will survive.

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice — for example, by posting the updated Terms with a new effective date or by notifying you through the Service. Your continued use of the Service after changes take effect means you accept the revised Terms.

These Terms are governed by the laws applicable at the principal place of business of QuickShift Labs, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in the courts located there, unless applicable law requires otherwise. Nothing in this section limits any mandatory consumer-protection rights you may have where you live.
